Did Progressive auto insurance majorly screw over a Maryland family?

I’m not one to usually report on insurance matters but this caught my attention: in a blog post, a Maryland man accused Progressive Auto Insurance of screwing over his family after his sister was killed when someone ran a red light.

You can read the full text over at his blog, but we’ve excerpted the major stuff below:

On June 19, 2010, my sister was driving in Baltimore when her car was struck by another car and she was killed. The other driver had run a red light and hit my sister as she crossed the intersection on the green light.

Now, I don’t discount the possibility that Katie was at fault in the accident, but it never really looked that way. The only witness who gave a statement on the day said that Katie had the light, etc. The totality of the evidence left some room for argument, but that will be the case any time there’s a catastrophic car accident that doesn’t happen underneath an array of video cameras.

One indication that the case was pretty open-and-shut was that the other guy’s insurance company looked at the situation and settled with my sister’s estate basically immediately. Now, because the other driver was underinsured, that payment didn’t amount to much, but my sister carried a policy with Progressive against the possibility of an accident with an underinsured driver. So Progressive was now on the hook for difference between the other guy’s insurance and the value of Katie’s policy.

At which point we learned the first surprising thing about Progressive: Carrying Progressive insurance and getting into an accident does not entitle you to the value of your insurance policy…

… In Maryland, you may not sue an insurance company when they refuse to fork over your money. Instead, what they had to do was sue the guy who killed my sister, establish his negligence in court, and then leverage that decision to force Progressive to pay the policy.

Now my parents don’t harbor much venom for the guy who killed my sister. It was an accident, and kicking that guy around won’t bring Katie back. But kicking that guy around was the only way to get Progressive to pay. So they filed a civil suit against the other driver in hopes that, rather than going to court, Progressive would settle. Progressive did not. Progressive made a series of offers (never higher than 1/3 the amount they owe) and then let it go to a trial.

At the trial, the guy who killed my sister was defended by Progressive’s legal team.

If you are insured by Progressive, and they owe you money, they will defend your killer in court in order to not pay you your policy.

Again, the blog is here, but what do you D&T readers think? Is this Progressive being an insurance company and following the rules or are they showing no heart?

    Sure, it might be cheaper to defend a killer than to pay off an insurance claim. But is it right? Absolutely not. If this story is true, then this story will hopefully end up a much bigger financial penalty to the company than just the court judgment.

    This time its Progressive, but having processed claims for 11 years, I can tell you that there are others far worse.. No insurance company is exempt from this situation and because each state has their own insurance regulatons, in another state this claim would have been settled right away. The one that I have had personal and professional problems with is the the good neighbor' they got to be number 1 by making millions on unpaid claims. Its like an epidemic and its everywhere.

    Progressive insurance sucks! I had one claim on my rv. they denied to pay we took our tv for two estimates at two local rv dealerships and they advised us to change insurance companies due to progressive never pays on claims and they continue to get

    Progressive insurance company is a fraud. They did not pay on my claim. My car was hit, the other driver was ticketed a traffic report was available. Progressive dragged their feet and then sent me a form letter that they will not assume responsibility but will continue to investigate. This company spends a fortune on commercials to get new customers but they do not back their paying customers if there is a claim. Progresive should be investigated.

They got a tow truck out the naxt day. We got a rental car. Enterprise told us we had the car for 40 days. The insurance adjustor drug their feet on inspecting damage. We called progressive daily trying to figure out what was going on and what to do. Then we got a heavy snow storm. Our town lost power. Progressive "faxed" paper work for us to sign and return. Our local insurance office is without power. They can't recieve a fax. Progressive called us today to tell us that our rental car needed to be returned tonight by 5p. We told them the situation. They said "Not my problem". They did hardly anything with our finance company. Sad thing is our finance company is doing more to keep us right side up on our lone. Why it we need full coverage? Why do banks and car lots require us to have full coverage? I could just as easily not pay the loan. Sure it would mess up my credit, but mot really my problem. The worse part of it, the body shop told us that besides the airbag, the damage was about $800 dollars to fix. We could have been back in out car a in a week tops. I'm paying on it. It's my car. There is no state requiremant for airbags, let alone the one that went off.
