Texas Bans Gay Divorce

Now this is just getting confusing. The 5th Texas Court of Appeals in Dallas ruled yesterday that it’s illegal for gay couples who were married in other states to get divorced in Texas.

In an effort to deny homosexuals any rights whatsoever in the realm of marriage, Texas has passed a law that forces gay couples to stay together against their will, reports Jamie Stengle “The Huffington Post.”

The purpose of the ruling was to overturn an October decision by District Judge Tena Callahan, who said two men legally married in another state could divorce in Texas.

Preventing gays from becoming unmarried appears to be a passion project for Texas Attorney General Greg Abbott, who is not only applauding the decision, but actively trying to invalidate Callahan’s ruling along with one other gay divorce by sending them back to the court for dismissal.

By invalidating gay divorces, isn’t he in some sense forcing gay marriage?

The irony is more delicious than a Texas-raised fillet mignon, but the ruling itself is disturbing. The strength of Texas’s homophobia is cringe-inducing on several levels.

Not being allowed to marry a partner would be maddening indeed, but nothing would feel more infuriating than being forced to stay married to someone I was over.

    It is obvious liberal cultural elite social science research is inadequate to prove or disprove what effect same sex marriage has on society. Judicial activism, at the state level, void of judicial restraint, is an area of the homosexual agenda that needs to be recognized for the disturbing reality it represents as it matures. So I say GOOD FOR YOU TEXAS! for not supporting the gay agenda to redefine our country's moral foundation!!!

    This is stupid. Gay marriage in Texas has the same legal status as a unicorn, ie NONE. It's not even illegal – it doesn't EXIST. They are merely living together, and if they don't want to any more then they shouldn't. If they want to get divorced, they should go somewhere their marriage actually exists.

    I understand they believe in unicorns in Massachusetts…

    They were never considered married in the State of Texas! Their marriage was NON-EXISTENT as soon as they crossed the state line! They don't need a divorce, because there is no legal standing or order in Texas that considers them married! Gay marriage is not performed, nor is it recognized as a legal status in Texas. How can someone grant a divorce without validating the marriage int he first place?

    This whole thing is another “back-door attempt” (pardon the pun, but entirely intended) at usurping the power of our citizens to govern our own state. If they want a divorce, they will have to move someplace that considers them married!

      Right these guys decided they would get married in Massachusetts spend a lot of money to move to Texas so they could spend even more money trying to get a divorce, just to further the “Gay agenda”. And you wonder why the rest of the country thinks of Texans as being ignorant hicks.

    The real question is whether if one of them decided to go ahead in Texas and marry someone of the opposite sex, without having first obtained a divorce from their same sex partner, they could be charged with bigamy.

    You know what that is a good question about marrying the oppisite sex could they get in trouble. I do have a friend in this position were she thought she wanted a female spouse but now regrets it and wants to go back to a a heterosexual relationship, she is in texas and her spouse is abusive.

    You'd think that Texas, a state which doesn't want to recognize same-sex marriage, would be thrilled at the opportunity to dissolve marriages that they don't like.
