Dr. Luke wants to subpoena fan behind #FreeKesha protests

Producer Dr. Luke is looking to subpoena Michael Eisele, the fan behind the #FreeKesha protests, claiming that Eisele colluded with Kesha Rose Sebert and her camp in order to spread “defamatory statements and tarnish [Dr. Luke]’s reputation.” If granted, the subpoena would compel Eisele to submit to questioning from Dr. Luke’s (Lukasz Sebastian Gottwald) attorneys.

The request, obtained by Pitchfork, reads:

Plaintiffs allege that Ms. Sebert and her representatives closely coordinated with Mr. Eisele to spread Ms. Sebert’s defamatory statements and tarnish Plaintiffs’ reputation. Plaintiffs further allege that Ms. Sebert, individually and through her representatives, has breached her contracts with Plaintiffs by, inter alia, encouraging and assisting Mr. Eisele in creating bogus Internet “petitions“ and in engaging in other tactics to pressure Sony Music Entertainment to terminate its business with Plaintiffs.

As such, Plaintiffs believe that Mr. Eisele has information that is material and necessary to the prosecution of this action and is not reasonably available from any of the parties.

Gottwald and Sebert have been battling in court since 2014 when Sebert filed a suit claiming Gottwald raped her and subjected her to emotional abuse during their time working together. As part of her claim, Sebert asked to be released from her contract with Gottwald’s Kemosabe Records, which is owned by Sony Music Entertainment. Gottwald then counter-sued, claiming defamation. Gottwald also sued Sebert’s mother for libel.

Eisele, a 20-year-old from Connecticut, launched an online petition along with Austin Dean last year demanding Sony let Sebert out of her contract with Gottwald. Eisele also organized two rallies outside Sony Music’s headquarters in New York in support of Sebert after a judge denied her request to be released from her record deal.

In August, Sebert dropped her claims of sexual assault in Los Angeles but is still pursuing the case in New York.
